WHAT SHIMA IS

Shima is a private place to keep photos, videos, notes and memories, alone or with the people you choose. It is not a social network: there are no public profiles, no followers, and no feed where your things show up.

YOUR ACCOUNT

You are responsible for keeping access to your account safe. If you think someone has got in without your permission, write to us.

You must be at least 14 to use Shima. If you are between 14 and 18, we suggest talking it over with your parents or guardians.

YOUR CONTENT IS YOURS

The photos, videos, notes and recordings you upload remain yours. We acquire no rights over them.

You give us only the technical permission needed to store them, process themthumbnails, compression, generating a book PDF if you ask for oneand show them to the members of your spaces. Nothing else, and never for advertising.

SHARED SPACES

By joining a shared space you accept how it works:

WHAT YOU CANNOT UPLOAD

Illegal content, content infringing third-party rights, and using Shima to harass or harm anyone are not allowed. On a well-founded report we may remove that content and close the account responsible.

PLANS AND PAYMENTS

Shima has a free plan and several paid ones. The prices shown in the app are the ones that apply, with taxes included according to your country.

Subscriptions bought inside the app are handled and charged by the store you bought them from (Google Play or the App Store), which acts as the seller. They renew on their own until you cancel, and are cancelled in that store: if you bought on Google Play, in Google Play → Profile → Payments & subscriptions → Subscriptions; if you bought on the App Store, on your iPhone, in Settings → your name → Subscriptions.

If a payment lapses, your account becomes read-only: you will not be able to upload more, but you keep access to everything you already saved. We never delete memories over an unpaid bill.

Cancellations take effect at the end of the period you have already paid for.

Changing plan. Moving up is immediate. On Google Play, Google charges you today only the difference left until your next renewal, and the billing date does not change; going from monthly to yearly charges the full year today and credits what was left of the month. On the App Store, Apple charges you for the new plan today and refunds the unused part of the old one; moving the same plan from monthly to yearly takes effect at renewal. Moving down is not charged: you keep the plan you paid for until it renews, and on that day you move to the new one. Cancelling is done in the store you bought from; pausing, only in Google Play.

If we refund a charge. On Google Play, Google allows two kinds of refund: the charge only, or the charge and the access. In the first case your plan continues as it is until the period ends; in the second it ends there and then. We tell you when it happens. On the App Store we cannot refund it ourselves: Apple does, and if it does, the plan ends there and then.

Codes and people who recommend Shima. On Android, a code can give you a discount, storage or a free plan for a while; what each one does is stated when you redeem it. If you arrived from the link of someone who recommends Shima, their code is applied by itself the first time you open the app, and that person may earn a commission if you end up paying: it does not cost you more and it does not change your price.

RIGHT OF WITHDRAWAL

If you are a consumer in the European Union, you have fourteen calendar days to withdraw from a purchase without giving reasons.

Subscriptions and the book PDF are bought inside the app, through the store you buy from (Google Play or the App Store). That means that store, Google or Apple, is the seller towards you, and that by purchasing you accept their terms. On Google Play, Google makes the content available to you immediately and, for that reason, under their terms you waive the right of withdrawal over that digital content. On the App Store, withdrawal follows Apple's terms. The printed book, when available, will be paid by card through Stripe, and there the seller is us.

Refunds. If you bought on Google Play, during the first 48 hours you can request a refund directly from Google through your Google Play account. After that, write to hola@shimaapp.com: we look at it case by case and we do not hide behind the store. If you bought on the App Store, only Apple can grant the refund: you request it at reportaproblem.apple.com, under its rules.

Subscriptions. On Google Play, if you withdraw within fourteen days, refunds follow Google Play's terms.

Printed books. When they become available, they will be made specifically with the photos you choose, so they will be a personalised product and excluded from the right of withdrawal — unless they arrive faulty or damaged, in which case write to us and we will sort it out.

THE PHOTO BOOK

Designing and previewing a book is free. You only pay to download the high-quality PDF.

The printed book is not available yet. When it is, it will be made and shipped by a partner printer, with estimated delivery times depending on the destination. It will be paid by card through Stripe, with the final price shown before you confirm.

You choose the photos: check the preview before paying. We cannot review the contents of every book before printing it.

AVAILABILITY

We make a reasonable effort to keep Shima working and to maintain backups, but we cannot guarantee uninterrupted service. There may be outages for maintenance or because of our providers' failures.

CLOSING YOUR ACCOUNT

You can delete your account whenever you want from Profile → Your account → Delete my account, inside the app, or from shimaapp.com/eliminar-cuenta.html. You have ten days to change your mind: signing in again cancels it. What happens to each thing is in the privacy policy: the spaces you shared pass to the person who has been in them longest.

We may close an account if these terms are breached seriously or repeatedly. We would warn you first unless it is something requiring immediate action.

LIABILITY

Shima is offered as it is. We are not liable for indirect damage or for content lost through third-party failures, through deletion you carry out yourself, or through losing access to your account.

None of the above limits the rights the law grants you as a consumer.

CHANGES

If we change these terms in any relevant way, we tell you inside the app before they take effect. If you do not agree, you can close your account.

GOVERNING LAW

These terms are governed by Spanish law. If you are a consumer, you may go to the courts of your own domicile.

The European Commission provides an online dispute resolution platform.

The Spanish version is the only one with legal value. Translations are offered to aid understanding.
